Online Rent Agreement Registration is Delayed? What to do?

Background

If you have registered a rent agreement through an online way then their may be times when even if you have completed whole of the process of submission, but still agreement is delayed for registration from the government side. In times like this it is very frustrating to keep waiting  for the agreement by just keeping mum. If we enquire the same with the agents throught which we have made the agreement they tell that they cant help in such situation as the registration is in hands of governement officials and they cannot force the process and their work was upto submission of agreement which was duly completed in time. Even if what he is saying is true its very frustrating to keep on waiting for the registration.  In such situation what should one do? is the major question. In this article we have tried to list out the things what can one do in such situation. 

List of things one can do:

1. Check if any SMS recieved from department

 If phone number of tenant and owner is included while submitting the rent agreement, then government of Maharashtra gives this amazing facility of updating of each stage of agreement through sms. The parties to the agreement receive sms in each stage viz: when agreement is submitted then an sms comes that your rent agreement has been submitted for registration, when agreement is registered then sms comes that your document has been registered with so and so sub register. Similarly if your document is queried by the sub register then also parties receive an sms which states that your document has been queried by sub register. In such case parties need to convey their agent this sms, so that they can check the exact query received and resolve the same and resubmit it.

2.Wait for average waiting time

Registration of leave and license is a completely online process and is done by different sub registers at different offices. The time required for registration totally depends upon the workload at their offices. Still on an average document takes 5 working days for registration. 

Sometimes it may take less time or sometimes it may take more time depending on the workload. However one must keep in mind that registration is a process and is not done immediately after submission is done. The sub register, registering the document has the responsibility to check the submitted agreement considering various parameters like are the photo clear, is the challan prepared correct etc. Hence the registration may take average time as mentioned above.

3. Register a Complaint with Online Call Centre or Mail

IGR department has a Customer care number 8888007777  which is operative from 9am to 9pm excluding government holidays. One can call the department and raise a complaint regarding the delay in registration with them. One can also mail the complaints to complaints@ igrmaharashtra.gov.in. Please be noted that for raising a complaint you should have token no of your submitted agreement. You can also ask your agent to raise a complaint to the department and keep you in cc for the same.

4. Visit JDR Office

  Registration of land and property documents is taken care by department of registrations and stamps, accordingly leave and license registration being part of property matters the same is also looked after them. Every time a rent agreement is submitted for registration it is allocated to one of the sub register offices available in the given taluka or district for registration. However,  their is no simple way to find out to which sub register office has the document been submitted. To know at which sub register office the document is submitted in online way for registration, one can visit Joint district registrar office (JDR Office) of the city where rented proeprty is located and request them to tell at which sub register office document is submitted.Once the same is known one can go to the respective sub register office and enquire about their pending rent agreement registration by giving them appropriate token no and date on which the document was submitted for registration. Conclusion

Above are the best possible ways to manually enquire and get your document registered if it is submitted in online way. However please remember that registration of document is a process and is done by authorized government official after due checking all the parameters, the given ways are just to enquire and to know why document is not yet registered, their is no way you can force the document to be registered. Also as the process is online, and an automated process, constantly asking the agent or ASP about why is document not yet registered or harrasing them for the same wouldnt help as thier work ends once they submit the document for registration, they should surely check online and update you and give you a soft copy once document is registered but they cannot force the registration. Also agent is left unanswered when he asks to which sub register office the document has went for registration, the same can be asked by party to  the document only. However checking the track record of registrations, the government department has done a applausble work by rolling out this online system of registraiton and also the document are registered very quickly for maximum documents. Still for few minimum documents , common citizen can go through above steps if rent agreement registration is delayed.
