Legal provisions regarding police verification of tenant

Landlords are required by law to complete police verification of their tenants. The offender may be punished with imprisonment for a term that may last till one month or a monetary penalty of Rs 200 under Section 188 of the Indian Penal Code (IPC), which deals with the disobedience of a legally issued order by a public worker.

But the necessity of tenant verification is frequently overlooked by landlords, who rent out their property without doing legal, due diligence. Negligent renting out is not only dangerous for the property but also the landlord’s well-being. In addition, you may be held liable for your tenant’s carelessness if they are involved in any criminal activity.

The government has also suggested the Draft Model Tenancy Act 2019, which intends to promote rental housing in India and make it lucrative for landlords and renters alike. Landlords, on the other hand, face a slew of issues when it comes to renting out their properties. If the renter commits criminal conduct on the landlord’s property, the landlord will be held legally responsible.

What is the importance of tenant police verification?

Tenant police verification helps avoid any illicit or illegal activity in the house/apartment, such as drug use, rave parties, etc. Therefore, tenants will naturally be hesitant to engage in such activities if police verification is performed.

The landlord would naturally feel more at ease if their property has been rented to someone with a good reputation and no criminal history. Police verification is even more beneficial if the landlord lives in a different city or country.

Following the expiration of their contracts, several foreigners may overstay in the country and seek work in smaller towns. They can be easily identified with police verification.

Types of tenant police verification

There are two ways to do your tenant’s police verification.

1.You can go to your nearest local police station > Fill out the tenant verification form (which can be downloaded from the police station’s website, or you can get it offline from the police station), and submit it to the sub-inspector.

2.Alternatively, you may go to the police station’s official website and obtain a police verification of your renter.

Online police verification of tenant

Please note this is available only in Delhi, Mumbai and Pune. You can Google search by typing – (Name of your location) online police verification of tenant. If the service is available, the desired results will be available in the works.

Every landlord should register the Leave and License Agreement and provide the information of their tenants to the local Police Chowki.

The following websites provide property owners with the ability to input their tenants’ information online. Only property owners or their agents should use these websites to submit information on their tenants.

  • Identity Proof No (any document like Aadhaar, PAN, Voter ID, Ration Card, Driving License, etc.)
  • A soft copy of the identity proof you’ve chosen
  • Occupation
  • Contact Number
  • EMail-ID
  • Work Address of Tenant

Persons Who Know Tenant –

  • Name and Phone Number of Person Who Knows Tenant
  • Agent Name (If present)
  • Phone Number of these people

Steps for online verification

  1. Open this link http://www.mhpolice.maharashtra.gov.in/Citizen/Login.aspx
  2. Click “Online Services” from the drop-down menu.
  3. “Create a citizen login,” fill in the required information, and create an account.
  4. Go to “Citizen Services”—>”Tenant/PG Information Request”—>”Add Tenant/PG Information Detail” after logging in to your account.
  5. Fill in all of the fields mentioned in the form.
